There may be an arbitration clause in your max care warranty, start the process. The warranty seems pretty black-and-white.

Can you try a different dealership? You may have some luck as not all dealerships are as good as the one we have next to us.

I know you are all waiting for the latest update... I finally spoke with my Service Advisor at the Dealership today, and he confirmed they did not report it as wear and tear. So, my next course of action is to have them perform the repair, and save the parts. I will take pictures, and send a certified mailing to Chrysler requesting payment. If they don't respond I will file a case with small claims court. It is really disappointing that @ChryslerCares has decided to not honor the warranty that they sold...
 
The warranty is likely through a third party insurance company. Rustproofing warranties are like that. Send you around in circles.

You state that you have the Maxcare Lifetime.

It clearly states that front and rear shocks are covered.

I blame the dealership on this. Shocks should have been replaced, deductible paid. Dealership would have been reimbursed the difference, with no questions asked since it's Max Care and a low dollar repair. The dealer opened this can of worms, and I can't believe that Chrysler won't honor their paid for warranty.
 
"they did not report it as wear and tear" Whats the difference?? That's why they wont cover tires, brakes, wiper blades and the like. So what if it's "wear and tear", IT'S A COVERED PART, unlike wear items I listed.

Dealer has said that they have to get approval for all repairs now... It is on @ChryslerCares and as you can see they are staying away from this conversation! If it was the dealer they would be getting engaged to help me through this! I am going to win in front of a judge if I have to take it that far!

Yes - I called, and escalated to a Supervisor... No ability to have the repair covered...

I’d try to push past the Supervisor to the next level. Like I said, Maxcare did the shocks on our 2010 at about 60,000 miles or so.

This topic has me again thinking of cancellng the remaining Max
Care on my van and ask for a refund. I know I won't get it all back, but I wonder if I will get enough back to just use to pay for repairs ourselves.

I was very happy with the warranty for several years, but now they seem to be doing everything they can to avoid paying.
 
Maybe they changed the warranty and are trying to make the change retroactive. Warranty Companies try to get away with that.

Bought a pair of downhill ski bindings with a lifetime warranty. They failed in a few years, actually fell apart, the plastic components lost their plasticizers. They tried to change the warranty on me but after a year of haggling I was able to convince them (with receipts) that I bought the bindings a week after they were recalled for defects. Got a pair of higher priced bindings, free of charge, for that effort.

They just can not.

Back on the 90's I bought a set of tires at Montgomery Wards which included a lifetime warranty.

My tires were replaced many times without a problem.

I then moved to another city. I had problems with the new Montgomery Wards store, they refused to honor said warranty. Luckily I had warranty documentation + receipts of all previous tire replacements. Manager had no choice but to honor said warranty.

Replaced all tires few more times, until Wards closed their store for good.

Tried calling the new online Wards, no luck. I was told it was a complete different store.
 
I suspect they are trying to draw a distinction between a shock/strut wearing out versus failing/breaking. If the vehicle is starting to bounce because the strut is wearing out and losing its dampening ability, then they will call it wear & tear and excluded from warranty coverage. If the shock/strut breaks or outright fails for some reason, then it is covered by warranty.

I had an old Subaru where I broke a rear strut after hitting a pothole. The suspension got real squirrel-ly immediately afterwards, and every time I hit the slightest bump the rear end would go side-to-side kinda like when losing control of a trailer. I almost fish-tailed after going over a bridge joint on a 4-lane highway, so I took it straight to the shop and was told I broke the rear strut.

I know that's not the popular answer, but I suspect that is the reasoning to deny coverage. But nonetheless, I hope the OP gets Chrysler to step forward and cover the rear shock issue.
 
In my opinion, I would not cover the broken shock in the pothole scenario you had. The fact it broke because you hit a pothole was not the fault of the shock. In the Max Care scenario, the shocks are failing because they are old and high miles. A paid warranty should cover them for life because they are listed as covered parts. Are they not going to cover, lets say a water pump because it is worn?
